abstract
El Derecho del Trabajo cuenta con un eje o punto de partida representado por los derechos y beneficios mínimos establecidos en la Constitución, cuando se presenta tal situación, y en la ley, lo cual conforma un conjunto que estructura la plataforma básica o punto de partida, cimientos si se quiere, sobre lo cual se debe construir el marco adecuado de compensación del significado del esfuerzo que los trabajadores entregan con su inherente incidencia en los beneficios que allí reporta su empleador. Esa construcción complementaria, aunque puede surgir de la decisión unilateral espontánea de la empresa, es la tarea que le compete desarrollar al Derecho Colectivo del Trabajo acudiendo para el efecto a la vía de la conversación, la negociación y la concertación,teniendo siempre como objetivo el equilibrio entre las partes, en el marco conceptual de una economía que gira en torno de la libertad de empresa con su inescindible objeto del ánimo de lucro.
Labour Law has an axis or starting point represented by the minimum rights and benefits established in the Constitution, when such a situation arises, and in the law, which forms a set that structures the basic platform or starting point, foundations if desired, on which the adequate framework of compensation of the meaning of the effort that the workers deliver with its inherent incidence in the benefits that their employer reports there must be built. This complementary construction, although it may arise from the spontaneous unilateral decision of the company, is the task that is incumbent upon the Collective Labor Law to develop the effect by resorting to the path of conversation, negotiation and agreement, always having as an objective the balance between the parties, in the conceptual framework of an economy that revolves around the freedom of the company with its inescapable object of the profit motive.
