El estudio de la Administración Pública ha sido un tema recurrente en la historiadel derecho y continúa siendo materia de gran actualidad. Esto se debe a que el Estado modifica constantemente sus funciones adaptándolas a las nuevas necesidades tendientes a lograr la prevalencia del interés general.El Estado colombiano debe seguir los lineamientos constitucionales establecidos en la Constitución Política de 1991, tendientes hacia la construcción de un Estado Social y Democrático de Derecho. Con base en esto, es necesario darle una serie de mecanismos que permitan aterrizar los postulados a la realidad.Al mismo tiempo, se debe reconocer que el Estado, en la realización de sus funciones, puede causar daños a los particulares y en estos casos, es necesario que entre a corregirlos, mitigarlos e indemnizar las lesionescausadas.En este orden de ideas, este proyecto de investigación se propone estudiar la Administración Pública desde dos perspectivas: La primera, más general, busca lograr una comprensión general de la actividad administrativa y la segunda, particularmente, se concentra en la manera de limitar las actuaciones del Estadopor medio de la responsabilidad patrimonial.
The study of public administration has been a recurring theme in the historyof the law and continues to be highly topical. This is because the State constantly modifies its functions by adapting them to new needs in order to achieve the prevalence of the general interest.The Colombian State must follow the constitutional guidelines set out in the 1991 Political Constitution, aimed at building a social and democratic State based on the rule of law. Based on this, it is necessary to provide it with a series of mechanisms that allow it to bring its postulates down to reality.At the same time, it must be recognized that the State, in carrying out its functions, can cause damage to individuals and in these cases, it must enter to correct, mitigate and compensate for injuries caused.In this vein, this research project aims to study public administration from two perspectives: the first, more general, seeks to achieve a general understanding of administrative activity and the second, particularly, focuses on how to limit the actions of the Stateby way of asset liability.
