  • The increase in global life expectancy, and its consequent increase in the prevalence of chronic non-communicable diseases, due to demographic transition processes, raises various challenges for social security systems and care processes. In this context, the protection of people who are suffering from cognitive impairment requires their characterization from a rights and vulnerability approach, given the risk of mistreatment, abuse and paternalism, which can be reinforced in the same processes designed for the protection of their rights. It is important to analyze the current regulatory frameworks to know the ethical and legal implications that protect this population group, , Law 1996 of 2019 defines the principles for the exercise of legal capacity and the protection of the legal act, as the manifestation of the will of older adults with disabilities, giving special emphasis to safeguard in this population group the principles of dignity, autonomy, primacy of will, non-discrimination, accessibility, equal opportunities and speed. In the clinical act of care, laws play an important role. Since, they promote from the legal field the development of various activities under regulatory frameworks solving ethical, philosophical, economic, cultural and social aspects of each person; in order to safeguard the medical act and the protection of patients' fundamental rights. For this reason, we will rely on the tools provided in Law 1996 of 2019 where it guarantees the legal capacity of this population group, their rights and legal capacity to make decisions, fill out health documents such as informed consent and anticipated directives.
