La propuesta establece vínculos entre la importancia de la justicia restaurativa y educación para la paz. En un primer lugar, porque la justicia restaurativa abre la posibilidad de promover un cambio profundo en la noción de justicia, desde el lugar de la retribución, donde el castigo es predominante, hacia la restauración donde los vínculos sociales son relevantes. Se trata de asumir una aproximación diferente frente al sujeto, donde debe dársele una especial relevancia a los vínculos sociales, así como buscar soluciones de reparación del daño causado. Las prácticas restaurativas comienzan a realizarse en Colombia con población juvenil perteneciente a pandillas en la ciudad de Cali (Britto 2010). La introducción en el ordenamiento jurídico tiene lugar con las leyes 975 de 2006 (Ley de Justicia y Paz) y con el Código de Infancia y Adolescencia (Ley 1098 de 2006) y también el actual modelo de justicia transicional establecido en el Acto Legislativo 02 de 2017 como Sistema Integral de Verdad, Justicia, Reparación y no Repetición, creado por el Acuerdo de Paz.
The proposal establishes links between the importance of restorative justice and education for peace.In the first place, because restorative justice opens the possibility of promoting a profound change in the notion of justice, from the place of retribution, where punishment is predominant, towards restoration where social ties are relevant.It is about assuming a different approach to the subject, where special relevance must be given to social ties, as well as seeking solutions to repair the damage caused. Restorative practices begin to be carried out in Colombia with a youth population belonging to gangs in the city of Cali (Britto 2010).The introduction into the legal system takes place with laws 975 of 2006 (Justice and Peace Law) and with the Childhood and Adolescence Code (Law 1098 of 2006) and also the current transitional justice model established in Legislative Act 02 of 2017 as the Comprehensive System of Truth, Justice, Reparation and Non-Repetition, created by the Peace Agreement.
