Este proyecto busca explorar, desde una perspectiva comparada, la teoría constitucional latinoamericana. A lo largo de su historia tanto colonial como republicana, América Latina ha participado creativamente en el diálogo global sobre el constitucionalismo moderno. Aun así, la particularidad de los aportes teóricos que desde esta región se hacen tiende a ser oscurecida por la hegemonía epistémica ejercida desde los principales centros de producción jurídica. Sin pretensiones de exotizar la teoría constitucional latinoamericana en sus múltiples manifestaciones, este proyecto busca reconocer los aportes que desde esta región se han hecho a las discusiones sobre los siguientes temas: la teoría de los derechos, la teoría de la separación de poderes, la relación entre la democracia y el constitucionalismo, el ejercicio del poder constituyente y las concepciones del pueblo y de la revolución. La exploración de estas discusiones también permitirá reconocer las similitudes y diferencias teóricas surgidas al interior de los países latinoamericanosen distintos momentos de la historia, pluralizando así la idea de una teoría constitucional latinoamericana.
This project seeks to explore Latin American constitutional theory from a comparative perspective. Throughout its colonial and republican history, Latin America has creatively participated in the global dialogue about modern constitutionalism. However, the particularity of its theoretical contributions tends to be obscured by the epistemic hegemony of the main centers of production of legal knowledge. Without any pretention to exoticize Latin American constitutional theory, this project attempts to recognize the contributions made from this region to the following discussions: the theory of rights, the relationship between democracy and constitutionalism, the exercise of constituent power, and the conceptions of the people and revolution. The analysis of these discussions will also contribute to the recognition of the theoretical similarities and differences within Latin America in different historical moments, in an attempt to pluralize the idea of a Latin American constitutional theory.
