abstract

  • This article specifies that in the actual conditions of constitutionalism and presidentialism of the Andean countries, the control of conventionality is a useful instrument to attain human rights and democracy, as it links the common judge and other state institutions to the task of controlling power, not only from the Constitution and the laws of the different States, but also from conventional law, and from the law contained within the international conventions on human rights signed by the Andean states which have a judicial body for oversight, control, and determination of responsibility.
