abstract

  • The thesis case study of the right to special protection of the inhabitants of the Medellín river includes a critical socio-juridical investigation on the real effects that this right produces in the state system of special protection in Medellin as a remedy to solve their situations of disadvantages in the social order. The essential core of this work questions that right to special protection as a form of material equality to combat in the Colombian social order the discrimination, marginality and manifest weakness of these disadvantaged subjects, which is analyzed through the case of the inhabitants from the street of the Medellin river. Based on this premise, the thesis gives an answer to this question: what regime of truth produces that so-called right to special protection within the life experience of these citizens according to the structures, practices and meanings or social representations that these have the legal-political action of the city in the remedy of their disadvantage in the social order? Consequently, it defends that the meaning of this right to special protection constitutes a regime that hides under the identity structures of subjects of special protection and inhabitants of the street an ambivalent sense in dispute, which hides the reproduction of the order of its domination and results in the failure of the recognition of the inhabitants of the street and of the real existence of a true right to the special protection for the materialization of their equality.
