El artículo analiza la necesidad de fortalecer el marco regulatorio y de gobierno corporativo en Colombia con el propósito de prevenir el greenwashing en productos financieros sostenibles. A través de un enfoque normativo y documental, se analizan los vacíos regulatorios existentes, como la falta de obligatoriedad respecto a la adopción de la Taxonomía Verde y estructuras sólidas de gobernanza en materia de sostenibilidad. Los resultados evidencian inconsistencias en la adopción de estándares, limitaciones en la protección al consumidor financiero y desafíos técnicos en la implementación de criterios sostenibles. Como conclusión, se propone la creación de un marco normativo que imponga reglas en cuanto a gobernanza, prohibición del greenwashing y gestión de riesgos ASG, con el fin de promover la transparencia, fortalecer la confianza y lograr un sistema financiero alineado con los ODS.
The article examines the need to strengthen the regulatory and corporate governance framework in Colombia to prevent greenwashing in sustainable financial products. Through a normative and documentary approach, it analyzes existing regulatory gaps, such as the lack of mandatory adoption of the Green Taxonomy and robust governance structures in sustainability matters. The results highlight inconsistencies in the adoption of standards, limitations in financial consumer protection, and technical challenges in implementing sustainable criteria. As a conclusion, the article proposes the creation of a regulatory framework that establishes rules on governance, greenwashing prohibition, and ESG risk management to promote transparency, strengthen trust, and achieve a financial system aligned with the SDGs.
