  • This investigation focuses on discover the strength or weakness related to state capacities in Colombia by using the regulation of urban wastelands property rights as a standard or measuring from a normative and institutional approach. These goods, which were those who were transferred from the Nation to municipalities, have several regulatory issues related to its identification, normative sufficiency, institutional management, titling, and public registration because its legal nature and uses are not yet define. To accomplish this purpose an analytical methodology was apply in which what was regulated and what was applied specific cases in Bogotá was confronted. The main result was that this regulation showed normative gaps and ambiguities, disparate judicial interpretation, and disharmony in the administration of public goods. In conclusion, it can be affirmed that the capacities of the Colombian state related to the regulation of urban wastelands property rights are weak because they are still under construction and their development has not yet defined the distribution rules.
