  • Wetlands (Pantanals) in accordance with the provisions of the RAMSAR Convention present fundamental ecological functions such as the regulation of hydrological regimes, as well as as well as serving as a habitat for characteristic fauna and flora, especially waterfowl. Likewise, and as recognized in the literature, they correspond to important sinks of Carbon of the Planet, which and in accordance with what is established within the United Nations Framework Convention on Climate Change, respond to an area of ​​great relevance for its conservation. The situation forces us to reinterpret the law and legal texts. Although the text cited comes from a treaty that does not directly relate to human rights, it does address a contingency whose impacts violate almost all human rights. The protection of these ecosystems, which will be very necessary to face this problem, constitutes one of the current challenges. The rulings analyzed in this work reflect the progressive recognition of the national courts of the different countries, in this sense.
