abstract

  • The objective of the research work is to analyze the incorporation of a differential approach in the mental health reparation measures included in the National Plan for the Search for Disappeared Persons (PNBPD) by 2030. As a tentative response, it proposes that the PNBPD by 2030 and the Protocol for the Psychosocial Accompaniment of Relatives in the Search Process for Disappeared Persons with a Humanitarian Approach incorporates a differential approach in accordance with international standards of International Human Rights Law. To demonstrate this, it synthesizes the reparation measures in mental health in cases of forced disappearance from a differential approach and analyzes its incorporation into the National Plan for the Search for Disappeared Persons 1980 -2000 of 2016 and the National Plan for the Search for Disappeared Persons by 2030. This analysis concludes by pointing out that the incorporation of international mental health reparation standards in cases of forced disappearance, originating from International Human Rights Law, has been partial.
