  • Propose new guidelines for the application of branding in Commercial Law in Colombia from a legal and strategic perspective. The context of this study focuses on the relationship between commercial law and branding in the Colombian context. Branding is a key tool for companies, as it enables them to set themselves apart within an intensely competitive market and strengthen their brand in the perception of consumers. However, it is important that brands comply with commercial law regulations to ensure their reputation and credibility in Colombia. To this end, an exploratory and documentary research methodology was used, which included the exhaustive review of relevant documents such as technical reports, books, scientific articles and legal documents. In addition, surveys were conducted with legal and marketing professionals to obtain additional information. The primary outcomes derived from this study highlight the importance of branding as a key tool for companies in Colombia, allowing them to achieve a differentiating factor in a competitive market and attract more customers. In addition, the importance of compliance with commercial law regulations is highlighted to ensure transparency and fair competition between companies. The consequences of this research hold significance for both businesses and consumers. The implementation of new branding regulations in Colombia will contribute to strengthening the legal framework, protecting intellectual property rights, and promoting fair competition among companies, fostering a fairer and more trustworthy business environment.
