  • Among the multiple dilemmas that must be resolved when structuring a transitional justice process is the possibility of constructing policies that respect the standards of international law and do not represent an obstacle to reaching an agreement between the parties in conflict. This article proposes that the national margin of appreciation is a suitable mechanism for the incorporation of the judgments of the Inter-American Court of Human Rights at the national level and, more specifically, in transitional justice processes. To this end, the national margin of appreciation and its compatibility with the control of conventionality, the criticisms to the incorporation of the margin of appreciation in the American context and the possibility of using the margin of appreciation in transitional justice contexts will be explained, as a suitable mechanism to incorporate and harmonize the decisions of the Inter-American Court with transitional justice processes.
