  • This study comprehends an overview of the human rights situation of indigenous peoples in Colombia during the first term of President Juan Manuel Santos. The research is aimed to explain the measure in which the Rule of Law must abide by the notions of Principle and Law in order to guarantee the pertinent applicability of fundamental rights in a society characterized by pluralism. Neo constitutionalist authors, Gustavo Zagrebelsky and Luigi Ferrajoli, are referenced throughout the study due to the high explicative value of their approaches in regard to the notions of Principle and Law within a pluralist society. Hence, it is latter stated that political action must be in accordance with Constitutional dispositions in order to vie for the promotion and protection of human rights.
