  • The present doctoral work studies the Right to Traditional Knowledge in the black communities of Colombia, as a fundamental collective right that guarantees the generation of scientific knowledge resulting from cultural processes, which testify and identify the historical and dialogical consciousness that the ethnic group has had to establish for survival in their collective territories. In the first place, this thesis describes the conceptual foundations that allow us to contemplate the scope of the ethical and legal content of the law, which do not make it enforceable from the individual, but from the population as a whole that recognizes itself as such and that shares a past , a cultural and ethnic experience that justifies this differential treatment. The right under study is a special right, based on the necessary application of the principle of diversity and ethnic and cultural integrity. In this sense, an interpretative study of the Colombian constitutional, jurisprudential and legal framework is made to determine the integrating elements of the law. Subsequently, the thesis analyzes the generalized and totalizing conceptualization of the right to traditional knowledge, which starts from the preconceived idea of ​​grouping all the rights that derive from the community - knowledge relationship as an intellectual property right, where it could be identified that this type of property has a regulatory function that does not necessarily protect the collective interests and aspirations of these communities in relation to their traditional knowledge.
