abstract

  • The emergence of digital platforms has represented a disruptive change in various areas of human relations, in fact, social networks, entertainment portals and applications are increasingly popular in everyday life. Given the promising development of activity on digital platforms and the -still- incipient digital deepening of the habits of Colombians, the objective of this document is to clarify the main challenges and recommendations regarding the protection of personal data on digital platforms in Colombia. Despite the benefits of digital platforms, currently in Colombia some challenges persist, such as the lack of incorporation of digital terminologies in the regulatory framework, as well as the lack of clarity in the authorizations provided by consumers, lack of regulation in the process profiling, entry barriers due to the accumulation and centralization of personal data in few digital platforms as well as the non-existence of the right to data portability, among others identified. The strategies, mainly regulatory, of Colombia are identified to compare them with those implemented in different countries and regions. Therefore, a series of public policy recommendations are made for the Colombian case in three time lines: short, medium and long term directed towards companies, users and the government.
