  • This doctoral thesis will establish if the declaration of nature as subject of rights is useful, support or blocks indigenous territories defense, from first nations people such as Awá in Colombia, victim of an armed conflict because of armed actors, which dispute their land. To confirm this, the ecocentric paradigm and Earth law are studied that are the foundations for new subjects of rights declarations, as well, the theories of legal personhood and its bases to obtain a new legal status. Likewise, Colombian case law Will be analyzed to establish how judges grant these rights and its instrumental and symbolic effectiveness. Additionally, the field work reveals the knowledge and perceptions from the Awá People about nature, which could contribute to strengthen this juridical category with an intercultural perspective. Also, the field work was approached through Altesofía, another way to knowledge. At the end of this work was identified the need for an intercultural legal practice that includes the ancestral knowledge to strengthen the declaration of new subjects of rights.
