What would be the arguments to be presented to the Contracting Entity to solve the inappropriateness in the reestablishment of the economic equation of the state road concession contract as a result of the cost overruns assumed by the EPC Contractor, since (i) such cost overruns are not recorded in the Concessionaire's accounts, (ii) by virtue of the principle of contractual relativity, the cost overruns of the EPC Contractor are alien to the State Entity and, in any case, (iii) since the EPC Contract is governed by private law, Article 868 of the Code of Commerce is applicable to it.
