This academic work was originated by the concern caused by the lack of legislation regarding the filiation system based on Assisted Reproduction Techniques. The objective is to establish the basis of the filiation system derived from ART, taking into account the intention of the Constituent in the article 42 of the Political Charter. In order to determine the above, it was explained what ART consists of, the normative antecedents regarding filiation and ART were compiled, comparative law was also used and conclusions were drawn.
