This academic project arose due to the interest in determining the relationship between the stock market and the role that the Civil Cassation Chamber of the Colombian Supreme Court of Justice has assumed in front of it. Taking as a starting point one of the businesses in particular of the stock market law, the stock market commission contract, a legal business that was carried out a detailed study with the support of national and foreign doctrine, and then made a jurisprudential compilation that included 91 years, where certain patterns were found associated with the liability of commission agents, this being one of the questions that was posed in this monograph and which as a result showed a trend linked to the personal contractual liability of commission agents, according to the applicable legislation. Globalization, constant technological and legislative advances have been disruptive enough to change the traditional, affecting the role of judges and that of the stock market, which in a few years will face very important challenges that range from modifying the negotiation of securities, improve the security of investments and optimize the experience of services offered by stock brokers, which is why a second question was raised associated with the possible jurisprudential challenges that they could present, establishing certain problems and trying to provide solutions linked to the laws already possible legislative modifications.
