  • This monograph delves into a comparison between the insolvency laws of Colombia and Chile, clarifying main elements as particulars that define the distinctive characteristics of each country in terms of insolvency. This paper observes key elements such as jurisdiction and competence, admissibility requirements, legitimacy, effects, deadlines, creditor protection mechanisms, priority of claims, and the functions of the different actors involved in the process. The documentary comparison of the aforementioned aspects is carried out through documentary research of primary and secondary sources. The main objective is to exhibit the different inherent characteristics of Colombian and Chilean legislation in detail, comprehensively understanding the particularities and their approach to solving such problems. Despite the fact that both legislations seek to reduce this economic problem with the modernization of their regulations, there will be some fundamental differences which take into account the legal, administrative and social realities of each country.
