  • Fashion represents a multi-millionaire industry, that is built through the creative work of designers. It has found its legal protection through Fashion Law, a new area of law that seeks to attend the needs of the sector in a timely manner. Therefore, this article seek to determine the importance of implementing new legal tools within Colombian legislation to grant adequate protection to fashion designs through this new regulatory block. To achieve this objective, firstly, the investigation presents the general overview of this new branch of law, the relevance of the fashion market in Colombia and the legal instruments of intellectual property that, although insufficient, have been used in Colombian law. Secondly, the legal instruments of this new branch of law are studied and the need for its incorporation into the Colombian legal system is proposed. This analysis leads us to conclude that it is possible to adopt this type of regimes in the development of document CONPES 3866.
