abstract

  • The so-called Reinforced Labor Stability is a legal concept that deepens the fundamental principle of Labor law, which is of Labor Stability. The latter seeks to protect workers in general against arbitrary dismissals, while Reinforced Labor Stability strengthens the general guarantee applicable to all workers, to protect specific groups considered vulnerable to dismissal. Among the groups considered vulnerable are pregnant or breastfeeding women, workers with disabilities or some disabling health conditions, mothers who are heads of households, and unionized workers, especially during the development of collective labor conflicts. The purpose of this article is to present a state-of-the-art review of the principle of Reinforced Labor Stability due to its effects on workers’ health within the Colombian legal context. To do this, three main research approaches will be used. The first approach is of a legal nature and will summarize the regulatory background that establishes or enshrines the principle. The second approach will present the specific norms that enshrine reinforced labor stability for health reasons, including binding international instruments within the Colombian legal system. Finally, the third approach will be jurisprudential, analyzing the decisions made in the application of the studied principle.
