Access to assisted human reproduction techniques in Colombia: Disparity between the recognition of reproductive rights and their effective implementation

La financiación pública de las tecnologías de reproducción asistida (TRA) es un tema controvertido. Algunos sistemas de salud han propuesto financiación pública de las ART. En los últimos años se ha evidenciado un cambio en la línea de la jurisprudencia y legislación en Colombia sobre este tema. Este artículo analiza la tensión entre el reconocimiento de los derechos sexuales y reproductivos individuales y el bien común, en términos de la sostenibilidad del sistema de salud y el uso razonable de recursos limitados para satisfacer las necesidades de salud de la población. Este artículo concluye que, a pesar de los avances normativos, no ha habido avances correspondientes en su implementación efectiva y el reconocimiento de los derechos reproductivos.
Public funding of assisted reproduction technologies (ARTs) is a controversial issue. Some health systems have proposed public funding of ARTs. In recent years, there has been evidence of a change in the line of jurisprudence and legislation in Colombia about this topic. This article analyzes the tension between the recognition of individual sexual and reproductive rights and the common good, in terms of the sustainability of the health system and the reasonable use of limited resources to meet the health needs of the population. This article concludes that, despite regulatory progress, there has been a lack of corresponding progress in their effective implementation and the recognition of reproductive rights.
