An essential part of the peace agreements signed between the Colombian government and the FARC is the transitional justice system. The heart of this system is the Special Justice for Peace (JEP), specifically the Peace Tribunal and the adjoining chambers. This project seeks to take advantage of the unique opportunity to study the initial stages of the creation and functioning of a high-profile, broad-jurisdictional national court such as the JEP to answer two interrelated questions of theoretical and empirical relevance: what factors explain the legitimacy of the courts in the eyes of citizens? How do individuals construct their evaluations of the courts? I propose to design a survey that includes two experiments created especially to evaluate the importance of different factors in the construction of judicial legitimacy. The start-up fund will partially finance the cost of contracting the execution of the telephone survey with a polling firm.This study will make an important contribution to comparative literature but is also relevant to national reality. Given the controversy surrounding the peace process in general, and the gestation of the JEP in particular, its legitimacy, independence and ability to produce decisions that are accepted by the public are issues of crucial importance for the implementation of the Havana agreements. Studying the initial stages of this court in a rigorous manner will contribute to building a much-needed baseline to put into context and better understand an institution that will be central to the political dynamics of the coming years in Colombia.
Una parte esencial de los acuerdos de paz firmados entre el gobierno colombiano y las FARC la constituye el sistema para la justicia transicional. El corazón de este sistema es la Justicia Especial para la Paz (JEP), específicamente el Tribunal para la Paz y las salas adjuntas. Este proyecto busca aprovechar la oportunidad única de estudiar las etapas iniciales de creación y funcionamiento de un tribunal nacional de alto perfil y amplia jurisdicción como la JEP para dar respuesta a dos preguntas inter-relacionadas y de relevancia teórica y empírica: ¿qué factores explican la legitimidad de los tribunales en los ojos de los ciudadanos? ¿Cómo construyen los individuos sus evaluaciones de las cortes? Propongo diseñar una encuesta que incluya dos experimentos creados especialmente para evaluar la importancia de distintos factores en la construcción de la legitimidad judicial. El fondo de arranque financiará parcialmente el costo de contratar la ejecución de la encuesta telefónica con una firma encuestadora.Este estudio hará una contribución importante a la literatura comparada pero también es relevante para la realidad nacional. Dada la controversia que rodea el proceso de paz en general, y la gestación de la JEP en particular, su legitimidad, independencia y capacidad de producir decisiones que sean aceptadas por el público son asuntos de crucial importancia para la implementación de los acuerdos de La Habana. Estudiar las etapas iniciales de esta corte de manera rigurosa contribuirá a construir una muy necesaria línea de base que permita poner en contexto y comprender mejor una institución que va a ser central para la dinámica política de los próximos años en Colombia
