El presente proyecto se propone diseñar una estrategia de respuesta a la corrupción asociada al crimen transnacional organizado, a partir del derecho internacional y de una adecuada comprensión de las dinámicas de comportamiento del sistema de narcotráfico marítimo en Colombia y las Américas, prestando particular atención a la respuesta ofrecida para Colombia desde el derecho público comparado.El proyecto se centrará, en primer lugar, en las herramientas de naturaleza no penal, para a continuación abordar las posibilidades que ofrece el derecho penal transnacional y el derecho internacional penal. Se analizará, en particular, si la creación de una institución de ámbito regional para promover la coordinación entre las autoridades nacionales y mejorar su cooperación en materia de prestación de ayuda judicial mutua y ejecución de peticiones de extradición, reforzaría la eficacia de las medidas que el derecho público comparado aconseja adoptar en el derecho interno colombiano. Así mismo, se estudiará si dicha eficacia podría también verse reforzada por la utilización de algunos de los mecanismos de aplicación del derecho internacional penal, como sería la creación de una Corte Latino-Americana y del Caribe contra el crimen transnacional organizado (con inclusión, o no, de una agencia supranacional de recogida y análisis de información).
This project aims to design a strategy to respond to corruption associated with transnational organized crime, based on international law and an adequate understanding of the dynamics of the maritime drug trafficking system in Colombia and the Americas, paying particular attention to the response offered for Colombia from comparative public law.The project will first focus on tools of a non-criminal nature, and then address the possibilities offered by transnational criminal law and international criminal law. In particular, it will analyze whether the creation of a regional institution to promote coordination between national authorities and improve their cooperation in the provision of mutual legal assistance and the execution of extradition requests,would strengthen the effectiveness of the measures that comparative public law advises to adopt in Colombian domestic law. It will also be studied whether such effectiveness could also be reinforced by the use of some of the mechanisms for the application of international criminal law, such as the creation of a Latin American and Caribbean Court against transnational organized crime (including, or not, a supranational agency for the collection and analysis of information).
