En esta contribución se busca dar una respuesta no convencional a la pregunta formulada por el valor jurídico de la Declaración Universal de los Derechos Humanos, en atención a que, sin tener el carácter vinculante de un tratado, sus disposiciones han sido citadas o se han incluido expresamente en múltiples constituciones y leyes, y sus principios han servido como base de pactos, convenios y tratados de derechos humanos, de manera que, aunque en apariencia no pasaría de ser un instrumento de soft law, su contenido ha servido como referente para la adopción de diversos instrumentos convencionales sobre derechos humanos, aún si muchos Estados no respetan las obligaciones internacionales en este ámbito
This contribution seeks to provide a non-conventional answer to the question posed by the legal value of the Universal Declaration of Human Rights, in view of the fact that, without having the binding character of a treaty, its provisions have been cited or have been expressly included in multiple constitutions and laws, and its principles have served as a basis for human rights covenants, conventions and treaties, so that, although it would seem to be no more than a soft law instrument, its content has served as a reference for the adoption of various conventional human rights instruments, even if many States do not respect international obligations in this area.
