The purpose of this research is to make an approximation to the institution of extracontractual responsibility of the State in the last quarter of the 19th century, in order to know how the State responded patrimonially for the damages caused during the civil war of 1884- 1885 The text will be divided into three chapters, the first that goes back to the reader to the political and social background of the war, the second addresses the incidents of the civil war of 1884-1885 and the third dealing with the extracontractual responsibility of the State emanated from the Constitution, Law and Jurisprudence, which in turn will emphasize individual rights, especially in the right to property, as they seek to claim the property that the war usurped.
