abstract

  • The Colombian legal system provides only compensation as a form of reparation in events of unjust deprivation of liberty. In international law, reparation also includes compensation, compensation measures, restitution, rehabilitation, satisfaction and guarantees of non-repetition, which not only apply to serious violations of human rights, but also to any violation of a right enshrined in a conventional norm that the State has committed to respect, protect and guarantee. The purpose of this document is to analyze the content and scope of the right to reparation in international law as a fundamental right and its usefulness in determining reparation measures in the context of control of direct reparation for unjust deprivation of liberty.
